Hi there,
get a hold of a quicktime pro license, export a file from there, then open it in quicktime and ´wade through all the advanced settings (sorry I´m at home, no pro here to guide you along) and look for the layermodes, it´s often that "dither copy" will look washed out but at least one of the other modes resembles what you´re after. It´s somewhere there where you can also set stuff like looped playback, highquality display and such.

If I had any choice over compression format I wouldn't be using H.264 thats for sure!

help? Yup - tried that and tried compressing it with a million different apps too (well perhaps 5 different apps) - no matter what goes in black always comes out at 16.16.16 and white 236.236.236 - referring back to Gregs post it definitely seems to be a bug interpreting colour profiles. Great!

Not that it'll help but I think 16-235 was the approximate range for NTSC color space.
There's a whole thing with rgb not quite fitting in to ntsc and back in the day you usually needed to check video signal output to make sure that you're outputting "legal" colors and it sounds like the system is second-guessing you on this.
So maybe you need to pick a non-ntsc (or television) compression format?
