Yes, for a while. Not just layers either. I guess somewhere in the process of visiblity properties, groups, layers, and partitions it can get confused. Usually I have to set the visibility control to "no effect" then back to hide or show for it to work. Sometimes they can fight each other, etc. A scene reload usually fixes the problem, at least temporarily, which makes it work for rendering. While you are working though it can be a pain.

I was able to break them again quickly.
After I get this project out, I'll see about trying to repro the steps.

If anyone else has had layer 'issues' with visibility, and render vis, please let me know!! 
This is a workflow annoyance for sure.

However, when I turn off Layer Default ( nothing changes ) but THEN the new layer works.
Very buggy.
